1. Personal data
    We collect, process and use your personal data only with your consent or mandate or order for the purposes agreed with you or if there is another legal basis in accordance with the General Data Protection Regulation (GDPR), while complying with data protection and civil law provisions.

    Only such data that is required for performing and conducting our legal services as lawyers or that you have made available to us voluntarily will be collected. In order to prevent money laundering and financing of terrorism, we are obliged to process personal data in context with transactions with increased risk of money laundering (e.g. real estate transactions or establishment of companies) on the basis of the Rechtsanwaltsordnung (RAO).

    Personal data means all data containing individual details about personal or factual circumstances, such as name,  address,  e-mail address, telephone number,  date of birth, age, sex, social security number, video recordings,  photos, voice recordings of persons and biometric data such as fingerprints. Sensitive data, such as health data or data relating to criminal proceedings, may also be included.

     
  2. Information and deletion
    As a client or as a data subject in general, you have the right, while we are maintaining the professional duty of secrecy for lawyers, at any time to obtain information about your personal data stored, its origin and recipients and the purpose of  data processing as well as the right to correction, data transmission, objection, restriction of processing and blocking or deletion of incorrect or inadmissibly processed data.

    If your personal data changes, please inform us accordingly.

    You have the right to revoke your consent to the use of your personal data at any time. Your request for information, deletion, correction, objection and/or data transmission, in the latter case, provided that this does not involve disproportionate efforts, can be sent to the contact data indicated in item 10. of this declaration.

    If you believe that our processing of your personal data violates the applicable data protection law or your claims under data protection law have been infringed in any other way, you may file a complaint with the supervisory authority in charge, which, in Austria, is the Data Protection Authority.

     
  3. Data security
    Protection of your personal data takes place using appropriate organisational and  technical precautions. These precautions relate in particular to protection against unauthorised, illegal or accidental access, processing, loss, use and manipulation.

    Irrespective of our efforts to maintain an appropriately high level of due diligence at all times, it cannot be ruled out that information you disclose to us via the Internet may be viewed and used by other persons.

    Please note that we therefore accept no liability whatsoever for the disclosure of information due to errors in data transmission not caused by us and/or unauthorised access by third parties (e.g. hacking of e-mail account or telephone, interception of faxes).

     
  4. Use of the data
    We will not process the data provided to us for purposes other than those covered by the mandate agreement or by your consent or otherwise by any provision in accordance with the GDPR, with the exception of the use for statistical purposes, provided that the data provided has been anonymised.

     
  5. Transmission of data to third parties
    In order to fulfil your instructions, it may also be necessary to pass on your data to third parties (e.g. opposing parties, substitutes, insurance companies, service providers which we use and provide data to etc.), courts or authorities. Your data will be passed on exclusively on the basis of the GDPR, in particular to fulfil your instructions or on the basis of your prior consent.

    Furthermore, we inform you that, within the scope of our representation and support as lawyers, you will also receive factual and case-related information from third parties on a regular basis.

    Some of the above-mentioned recipients of your personal data are located outside your country or process your personal data there. The level of data protection in other countries may not be the same as in Austria. As a fundamental rule, however, we transmit your personal data only to countries for which the EU Commission has decided that they have an adequate level of data protection or we take measures to ensure that all recipients have an adequate level of data protection by concluding standard contractual clauses (2010/87/EC and/or 2004/915/EC). Exceptionally, data will be transmitted also to countries without an adequate level of data protection or the conclusion of a standard contractual clause if transmission is necessary to assert, exercise or defend your legal claims (e.g. transmission to a foreign lawyer to recover your claim abroad).

     
  6. Disclosure of data leaks
    We make every effort to ensure that data leaks are detected at an early stage and, if necessary, reported to you and the supervisory authority in charge immediately, taking into account the respective data categories affected.

     
  7. Storage of data
    We will not store data for longer than is necessary to fulfil our contractual or legal obligations and to avert any liability claims.

    This website does not use cookies.

     
  9. reCAPTCHA
    n order to protect your inquiries via Internet form we use the reCAPTCHA service of Google Inc. (Google). The query serves to differentiate whether the entry is made by a human being or is misused by automated, mechanical processing. The query includes transmission of the IP address and any other data required by Google for the reCAPTCHA service to Google. For this purpose, your entry will be transmitted to Google and further used there. However, your IP address will be shortened by Google in advance within member states of the European Union or in other contracting states of the European Economic Area. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and shortened there. On behalf of the operator of this website, Google will use this information to evaluate your use of this service. The IP address transmitted by your browser under reCaptcha is not merged with other data of Google. Such data is subject to Google's deviating data protection regulations.   10. Server log files
    To optimise our website with regard to system performance, user friendliness and the provision of useful information about our services, the provider of the website automatically collects and stores information in so-called server log files which your browser automatically transmits to us. This includes your Internet protocol address (IP address), browser and language setting, operating system, referrer URL, your Internet service provider and date/time.

    The data will not be merged with personal data sources.  We reserve the right to subsequently check this data if we become aware of concrete indications of unlawful use.

     
  11. Microsoft Teams
    We offer you the opportunity to communicate with us via "Microsoft Teams". This is a video conferencing tool offered by Microsoft Ireland Operations Limited, One Microsoft Place, South County Business Park, Leopardstown Dublin 18, Ireland and Microsoft Corporation, One Microsoft Way Redmond, Washington 98052 (in short: Microsoft).
    We would like to point out that Microsoft is based in the USA and that the data may be processed there. Further information on data processing in connection with the use of "Microsoft Teams" and the standard contractual clauses agreed between us and Microsoft can be found at: https://www.microsoftvolumelicensing.com/DocumentSearch.aspx?Mode=3&DocumentTypeId=67
    The use of "Microsoft Teams" is not a precondition for communicating with us. It is up to you to decide whether you want to make use of this option. As an alternative, we are happy to offer you face-to-face meetings and telephone conferences
